Rational approaches to subsoil use in Russia – new regulatory mechanisms and provisions

The legal realities of mining companies operating in Russia will be discussed at the 4th session of the MINEX Russia 2016 forum entitled Rational approaches to subsoil use in Russia – new regulatory mechanisms and provisions.

The Deputy Head at the Department of Mineral Resources at the Federal Agency for Subsoil Use, Mr Yaroslav Kitchalo will talk about the “first come-first served” practice of subsoil use, its results and difficulties.

Mr Denis Nikishin, the Deputy Director of Legal Affairs and Licencing of subsoil use at Rosgolekspertiza will discuss the changes in the state regulation for the governance of subsoil funds.In particular, Mr Nikishin will talk about the revised legal requirements for staff training and provision of project documentation for the execution of works related to geological exploration of mineral resources. He will also be reporting on improving the mechanism of amending the license for subsoil use as well as the planned licencing update after 2016 and finally he will touch on some questions of obtaining  land rights used for subsoil use purposes.

Ms Yuliia Zakharova, the Head of Licensing Department at “Nordgold Management” LLC will report on the changes in the mineral classification and the procedures of approval and examination of project documentation.

A partner at the North Rose Fulbright, Mr Levon Kocharyan will talk about the future of Metal Streaming Agreements in Russia.

Ms Nina Goulis who is a Tax and Legal Partner in KPMG will clarify the myths and realities of tax incentives for subsoil users. In her report, Ms Goulis will analyse current tax incentives for subsoil users (including tax benefits in the areas of advanced social and economic development) and possibilities of their practical use as well as look at interesting practical aspects and difficulties of receiving tax benefits.

A review of de-offshorisation practices and current tax initiatives will be presented by Alexei Kuznetsov, a Partner and Head of Business Tax Services in the CIS, EY.

The moderator for the session is Mr Evgeny Tulubensky, the Chief legal officer, corporate and regulatory affairs in Nordgold.

After the presentations, the discussions on the legal issues of the Russian mining business will be joined by Mr Nikolay Matyash, Chairman, Subcommittee for Subsoil Users of the Committee of Precious Metals and Precious Stones at the Chamber of Commerce and Industry of the Russian Federation, MS Dinara Dorizo who is an Of the Counsel at the Norton Rose Fulbright (Central Europe). Mr Matyash is planning to propose amendments to the Russian legislation relating to solid minerals.
